DECISION No.12/CVI/17 OF THE 106th SESSION OF THE ACP COUNCIL OF MINISTERS HELD IN BRUSSELS, BELGIUM, FROM 5th TO 6TH DECEMBER 2017

NON-TARRIFF MEASURES

 

The ACP Council of Ministers,

-             Meeting in Brussels, Belgium, from 5th to 6th December 2017,

 

HAVING REGARD to the outcome of the 20th meeting of the ACP Ministerial Trade Committee on non-tariff measures and Council’s further exchanges thereon;

 

WHEREAS any country is entitled to establish measures to guarantee the health and safety of its consumers, animals and plants, but should ensure that the norms it adopts are compliant with the provisions of the WTO Agreement on SPS measures, and are not used as protectionist barriers

 

WHEREAS SPS and TBT issues have become key impediments for ACP States to gain market entry into the export markets, including the EU; 

 

SERIOUSLY CONCERNED about the implications on ACP competent authorities and operators of the New EU Plant Health Regulation, applicable as from 13 December 2019, which require that all living plant material will only be imported into the EU if accompanied by a phytosanitary certificate;

 

WHEREAS commodities listed as high risk by December 2018 will be prohibited from entering the EU market until a pest risk assessment is conducted;

 

CONCERNED that the proposed measures will be onerous for ACP States, most of whom do not have the capacity to cope with the proposed changes;

 

HEREBY DECIDES TO:

 

1.     Instruct the Secretary General and the Committee of Ambassadors to explore within the resources available under the 11th EDF to set up a programme to support ACP States to cope with the myriad of SPS, TBT and other norms and standards to enable continued and increased exports to the EU market; and

 

2.     Instruct the President of Council to forward this decision to the European Commission, Council of the European Union and the European Parliament as well as to African Union Commission and the ACP Regional Integration Organizations.
